A medical exam (a routine health physical) is required prior to training if a client has 2 or more risk factors for heart disease (age and medically treated excluded).

 

Agreement of Services, Waiver, and Policies

This agreement, made effective on today's date between (Russell Fitness DBA Ripped Performance)and Client (and/or party responsible for client if less than 18 years of age).

I, PARTICIPANT, agree to the cost of services presented to me and understand that these costs are valid for the work to be performed at this given time. Cost of service may change over a period of time should I request similar service at a later date. I fully agree to and have read the company policies and procedures. The payment and refund policies have been explained and presented to me in a clear manner. I agree to pay for service when rendered or in advance if required. I understand once I have used up the service upon purchase that I am neither obligated nor committed to continue unless chosen by me through the repurchase of additional services/programs.

Confidentiality Statement

I understand that my personal and medical information will not be distributed outside of Phenom Strength & Conditioning (under contract with Russell Fitness DBA Ripped Performance). The information gathered is solely used to benefit my health and physical performance. I am aware that the staff will use the quantitative statistics from my training for research and analyses towards the improvement of physical training. My name of personal statements towards (Russell Fitness DBA Ripped Performance) will not be used unless I have provided written approval for special circumstances to the staff of (Russell Fitness DBA Ripped Performance.). Photographs or video taken in house by the staff will remain in a secured area and can potentially be used on Ripped social media platforms and/or marketing material. I understand that any paperwork provided to me by the staff of (Russell Fitness DBA Ripped Performance.) concerning training nutrition and education is proprietary information from (Russell Fitness, LLC.) specific to my individual needs. I understand that redistributing this information for profit or for any other reason to other parties is prohibited without the consent of (Russell Fitness DBA Ripped Performance.)

I (Participant) acknowledge that any program of physical exercise involves a risk of injury. I have voluntarily chosen to participate in a program of progressive exercise. In signing this document, I acknowledge being informed of the strenuous nature of the program and the potential for unusual, but possible, physiological results including but not limited to abnormal blood pressure, fainting, heart attack and death. I have been recently examined b a medical physician and been found able to undertake a program of exercise.   For and in consideration of the design of an exercise program I, the client agree:

  1. That participant at his or her sole risk shall undertake any exercise program.
  2. That trainer shall not be liable to participant nor any other person for any claims or causes of action whatsoever arising out of or connected with the services of trainer.
  3. The client hereby releases and discharges trainer from any such claims or actions.

2013-2016 Policies

  1. Registration & Enrollment – Client must complete and sign registration forms prior to participation. If under the age of 18 years parent/guardian signature is required. Forms include: Contact information; Medical History; service Agreement; Confidentiality Statement, Waiver & Release; Policies & Procedure.
  2. Payment of Service- Payment of service(s) is expected to be purchased prior to time of service rendered or if required payment in advance. Please speak with staff to review current rates for the various services available. Rates are subject to change periodically. Upon Completion of sales, client will receive a sales receipt with description of purchase. Clients can choose to purchase by cash, check, or major credit cards (VISA, Master Card).
  3. Delinquent/Late Payments – When a customer is invoiced for nonpayment of service(s) and payment is not received within 15 days from invoice a late fee of $50.00 will be accessed. Further, should client exceed 30 days of nonpayment, (Russell Fitness DBA Ripped Performance) may require immediate payment in full, choose to terminate client’s service agreement, and include additional cost from collections and legal fees incurred by (Russell Fitness DBA Ripped Performance) There is a $35.00 administration fee for any returned checks, credit/debit draft, resulting from insufficient funds, account closed, or similar circumstances.

  4. Refunds & Transfers –(Russell Fitness DBA Ripped Performance) will gladly give a full refund on purchases that have not begun when requested by a client prior to an expiration date. Once the client has stated to participate in a service pre paid or purchased in advance (i.e. training packages) then the client is obligated to meet the terms of the contract. Pre paid training packages are nonrefundable nor transferable once participation begins.
  5. Moving/Medical Freeze – In the cases of a medical condition where client is unable to use service for 60 days or longer (with a signed statement by client’s physician) and/ or proof of client moving outside of the Washingtonian area then (Russell Fitness, Inc.) will refund the remaining balance minus a cancellation fee of $50.00. If client in the following cases choose to put their account on hold, then a 6 month freeze on their account will be honored by (Russell Fitness DBA Ripped Performance) It is the client’s responsibility to communicate with (Russell Fitness DBA Ripped Performance)of their status prior to the end of their 6-month freeze.
  6. Medical Exams –(Russell Fitness DBA Ripped Performance) strongly recommends that each client have physical examination including full blood and urine work prior to their initial assessment. If client has a history of serious medical conditions such as heart disease, client must consult with a physician prior to participation within the facility.
  7. Care of Facility – The care of the facility and equipment is expected from all clients.
    • Replace and return weights and items after each use.
    • Wipe down cardio and strength equipment after use.
    • Care safety taken when using free weights.
  8. Damages/Theft – Client and/or client gust will be held responsible and must pay for any damages sustained in the facility and/or property. (Russell Fitness DBA Ripped Performance) will not be held responsible for loss, theft and damage to personal property of client and/or guest.
  9. Guest – Guest is permitted to use the facility with members & participant’s arrangements must be approved by staff and proper paperwork completed by all guest prior to participation. Fees may apply.
  10. Assessments – All participants and members are required to complete an assessment with (Russell Fitness, Inc.) staff prior to training in the facility. The assessment is best conducted within a week prior to training or workouts. Assessments are conducted by appointment only.
  11. Checking- In – All participants and members e required to check in at Ripped Front office. Entrance from the rear of the facility is prohibited. Non-participants/members are not allowed in the workout area unless escorted by (Russell Fitness DBA Ripped Performance) Staff.
  12. Training Schedule – To ensure results, (Russell Fitness DBA Ripped Performance)requires training consistency from our clients. Clients are urged to contact the facility to make appointments and/or urged to set up their schedule in 30 days advances to ensure availability. Clients are also urged to use our online scheduling program (see staff for details) training may be scheduled daily, weekly, or monthly depending on the service purchase and agreement. Reservations are valid only after receipt of payment.
  13. Punctuality – Client is expected to arrive on time to their scheduled appointment. Tardiness past 20 minutes will result in an automatic cancellation (unexcused) and session charge. This policy is strictly enforced for group sessions to ensure safety and a timely schedule for all costumers.
  14. Cancellation of Services – A 12 hour cancellation notice is required prior to a scheduled appointment of client will be charged for the session. A cancellation may be in the form of a phone call, recorded message, email, text of through the online scheduler. Please speak with staff to receive detail contact information regarding this policy.
  15. Expiration of Session(s) – It is the client’s responsibility to schedule and use their training services prior to their expiration date. The expiration date is given at time of purchase along with the sales receipt. If the client fails to notify and contact Ripped Performance prior to the expiration date, then client forfeits sessions or monies that remain.
  16. Preparedness – Client should wear and bring appropriate gear, including toiletries, workout attire, proper athletic shoes, towels, and fluid for hydration-electrolyte replacement. Taking a post workout drink is essential and is highly recommended.
  17. Client Responsibility – (Russell Fitness, Inc.) will not be held responsible for the following situations:
    • Training or services provided outside of Ripped Performance
    • Previous injuries- pre-existing conditions
    • Any non-disclosure of items listed in the medical/registration package
    • Negligence while training with Ripped Performance
    • Client is required to inform Ripped Performance of any unusual discomforts, stresses, pain, or injuries occurred between sessions prior to training
  18. Termination of Service – (Russell Fitness, Inc.) may refuse service to a client as a result of the following situations:
    • Use of illegal, harmful, and/or performance enhancement drugs
    • Non-payment or delinquent payment
    • Training inconsistency (appointment no shows or repeated cancellations)
    • Commitment- unprofessional and disrespectful behavior
    • Using training or nutrition protocols not approved
